Construction Trusts

The Ontario Construction Act trust provisions imposes personal liability on officers, directors, and controlling individuals of corporations required to pay contractors, subcontractors, and suppliers, on construction projects. The trust provisions of the Construction Act provide a separate remedy from a lien which may be available in circumstances where lien rights have expired.
